Check Rotation and Overtime Terms Before You Sign!
Are you considering a high-impact career in the Saudi marine or energy sectors? Many of these roles feature a rotation schedule, such as working 28 days followed by 28 days of rest. While these schedules offer a unique lifestyle balance, it is important for international professionals to understand how the Saudi Labor Law views your "off" time.
A recent case in the Dammam Labor Court provided important clarity for everyone working under rotation contracts. A Marine Section Lead filed a claim for over 645,000 SAR, asking for overtime pay for the Fridays he worked over several years. He argued that because he worked every day while offshore, he should be paid extra for the missing weekly rest days.
However, the court ruled in favor of the employer. The reason is found in the way Saudi Labor Law manages rest periods for specialized industries. According to Articles 104 and 105, while every worker is entitled to a weekly rest day, these days can be accumulated and "bunched" together for those working in remote or offshore locations.
In this case, the employee’s contract specifically stated that his 28 day rest period was a consolidated block. This block covered all his weekly rest days, annual leave, and public holidays. Because the employee enjoyed a full 28 days of paid rest for every 28 days of work, the court found that he had already received far more rest than the minimum requirement of the law.
This ruling is actually a positive sign for the expat community. It shows that the Saudi judicial system respects the specific terms of professional contracts. When you sign a rotation agreement, you can have confidence that the system is structured and predictable.
Before starting a rotation role, always review your contract to see how your rest days are grouped. Understanding these details helps you plan your career and your life in the Kingdom with total clarity. The Saudi Ministry of Justice even allows these cases to be handled through remote litigation, making the process fast and accessible for everyone.
